Anti-Spam Policy
A7 Interactive offers a software and hardware solution, called « A7 Emailing », for the dissemination of e-mail in compliance with the anti-spam rules of the ISPs and the laws in force in France and / or abroad.
A7 Interactive does not own or manage databases.
All the data provided by the Clients (email addresses, content of e-mails ...) as part of the use of the A7 Emailing platform are the exclusive property of the Clients. A7 Interactive can not be held responsible for any bad practices of its customers (Collection, Abuse, non-compliance ...)
A7 Interactive engages its clients on a contractual basis to guarantee the valorisation and the perpetuation of the business.
The Anti-Spam Charter of A7 Interactive
As part of the acceptance of the contractual terms of use, operation and services, A7 Interactive customers agree to use the « A7 Emailing » solution according to the following obligations:
- Send only e-mails to recipients who have validly consented to receive these e-mails (OPT-IN) or to recipients who may receive e-mails without having consented to them in accordance with the applicable laws and regulations (OPT-OUT).
- Do not use a pre-checked form in accordance with the legal provisions in force.
- Ensure that the content of e-mails addressed to recipients does not infringe the rights of third parties (counterfeiting, plagiarism, violation of privacy, misleading commercial practice, denigration, unfair competition etc.)
- Have the necessary supporting documents to identify the method of acquiring, renting or making available the database used by the services provided that it is not directly responsible for the establishment of this database
- Carry out prior formalities with the competent bodies, and in particular with the CNIL in the case of France, including, where necessary, any necessary authorization for transborder data flows
- Ensure that any e-mail sent via the emailing platform is clearly identifiable as an e-mail addressed by the Client, which must therefore include the following information: a subject corresponding to the content of the e-mail, the right to object The recipients of the message to the commercial prospection as well as the identification of the service to which this right can be exercised, the full legal notices of the client and more specifically, with regard to France, their right of access, rectification, Opposition and suppression in accordance with Articles 32, 38 and seq. Of the Data Protection Act, as amended
- Ensure the protection of minors by inserting all warnings and information on the data collection form. These particulars must stipulate that the legal representative consents to the collection of information on the minor for which he is responsible
- Do not collect or process personal data that reveal, directly or indirectly, racial or ethnic origins, political, philosophical or religious opinions or trade union membership, or relating to health or Sexual orientation of these
Customers who do not comply with their contractual obligations, legal and regulatory obligations or send unsolicited emails will be immediately excluded from our services.
